Considers principles to be applied on application to appoint a litigation fried under CPR Part 21, and on applications for orders restricting access to statements of case and other documents under CPR r 5.4C and transcripts under CPR r 39.9.

TIMES NEWSPAPERS LTD v MCNAMARA [2013] EWHC B12 (Comm)

Considers the grounds on which permission should be given to a third party to inspect documents on the court file when proceedings are held in open court or in chambers, and specifically under r 7.31A of the Insolvency Rules 1986.  On the facts there was a strong public interest in allowing a journalist access to the documents on the court file, subject to limitations preventing publication of certain personal information.

HSH NORDBANK AG v SAAD AIR, QBD (Comm) 

A creditor which had obtained security over aircraft in Swiss proceedings was given permission under CPR r 5.4C to have copies of statements filed on an application for summary judgment by a mortgagee of the aircraft which claimed priority.
