THE CREATIVE FOUNDATION v DREAMLAND LEISURE LIMITED [2015] EWHC 2556 (Ch)

The claimant landlord obtained summary judgment on a claim for delivery up of a mural (attributed to Banksy) removed by the defendant tenant.  The defendant had not been entitled to remove the mural to comply with its repairing obligations, nor was it arguable that there an implied term in the lease providing for items removed to be the defendant’s property.
