MICHEL v MICHEL [2019] EWHC 1378 (Ch)

Summarises applicable principles for a finding of unfair prejudice [73].  On the facts  the claim failed because there had been no quasi-partnership and the petitioner had no right to be a director.

BARCLAYS BANK PLC v MARSDEN [2019] EWHC 3741 (Comm)

A customer’s swap mis-selling against a bank was a contingent claim which would be the subject of set-off in the customer’s bankruptcy under s 323 Insolvency Act 1986 but it was an abuse of process for the customer to raise the issue after having previously done so in earlier proceedings.

Duress does not extend to the use of lawful pressure to achieve a result to which the person exercising pressure believes in good faith it is entitled, and that is so whether or not, objectively speaking, it has reasonable grounds for that belief.
