P - Proceedings against company in administration

LAZARI INVESTMENTS LIMITED v SAVILLE; RE SSRL REALISATIONS LIMITED (IN ADMINISTRATION) [2015] EWHC 2590 (Ch)

A landlord was given permission under para 43 of such B1 Insolvency Act 1986 to to forfeit, by peaceable re-entry, a lease held by a company in administration.  On the facts the purpose of the administration would not be impeded and no identifiable purpose of the administration would be served by requiring the landlord to seek forfeiture by legal proceedings, rather than by peaceable re-entry.

THE GOVERNOR & COMPANY OF THE BANK OF IRELAND (UK) PLC v COLLIERS INTERNATIONAL UK PLC [2012] EWHC 2942 (Ch)

Permission can be granted retrospectively to commence legal proceedings against a company in administration under Insolvency Act 1986 Sch B1 para.43(6).

GAARDSOE v OPTIMAL WEALTH MANAGEMENT [2012] EWHC 3266 (Ch)

A claim had been started against a company in administration without permission required by Insolvency Act 1986 Sch B1 para 43.  But the company had since gone into liquidation and in those circumstances permission was not required to continue the claim.  If permission had still been required it would have been given retrospectively even though the administration had come to an end.
