SHAW v WEBB (RE BROWN BEAR FOODS LTD) [2014] EWHC 1132 (Ch)

The court refused in its discretion to make an administration order and instead transferred in a winding-up petition and appointed a provisional liquidator so that payments made after the winding-up petition had been presented remained void unless validated.

INFORMATION GOVERNANCE v POPHAM [2013] EWHC 2611 (Ch)

Although a company was insolvent, the court exercised its discretion against making an administration order where most of the liabilities were to connected persons, and the director who had made the application had by the time of the hearing been replaced by two directors who opposed administration.

IN THE MATTER OF INTEGERAL LTD [2013] EWHC 164 (Ch)

Grounds for refusing administration order considered.  Shortcomings in proposals were so serious as to call into question the proposed administrators' competence and independence.  Winding-up order made.

An administrator should apply to the court for directions under Insolvency Act 1986 Sch.B1 para.55 if his original proposals were rejected by creditors at their initial meeting.
